Ah, that changes things a lot. Try entering the serial number here: https://selfsolve.apple.com/agreementWarrantyDynamic.do

This will tell you whether or not Apple will exchange it. If it was jailbroken the only option is to restore from DFU mode. Google is your friend.

If you enter the serial number it will tell you if the phone has been decommissioned. It will also tell you if it is still in warranty.
