Only AT&T can unlock it. It sounds like they will not since they require the original owner to call, so your phone cannot be unlocked.

This is the risk with buying an iphone from a tourist instead of an official reseller.

Um did you not think about this when you bought it from the tourist? Of course he's not going to reply so he can say it was stolen and buy a new 4s or wait for the 5 without having to wait for the 2 year period. He may even be able to still be grandfathered in under the old "unlimited data plan" depending on his old contract and how AT&T or Verizon treats a stolen phone per se. Now only if I could find a person to buy mine without asking for my personal info so I too can get a new phone before 2013! Brick
